Privacy (Québec Law 25)
Évolution Plus inc. operates this store from Québec, Canada. We treat your personal information seriously and in line with Québec's Law 25 (the Act to modernize legislative provisions as regards the protection of personal information) and Canada's PIPEDA. This page explains what we collect, why, and the rights you can exercise at any time.
What we collect
- Account information — name, email, password, and language preference when you create an account or sign in.
- Order information — shipping and billing address, phone, order history, and support messages.
- Payment information — handled by our payment processor. We never see or store your full card number; we only receive a confirmation and the last digits.
- Your Garage profile — the vehicles you save (make, model, year, engine) so we can show you parts that actually fit.
- Browsing data — pages viewed, searches, and basic device/analytics data to keep the site working and improve it.
Why we collect it
To process and ship your orders, confirm fitment for your vehicle, provide support, prevent fraud, meet our legal and tax obligations, and — only with your consent — send you news and offers. We collect the minimum needed for each purpose.
Consent
We ask for your consent before using your information for anything beyond completing your order and the basic operation of the site. Marketing emails are opt-in, and you can withdraw consent at any time — there's an unsubscribe link in every email, or just write to our Privacy Officer below.
Social login
If you sign in with Google, Apple, or a similar provider, we receive only the basic profile data (name and email) needed to authenticate you and create your account. We use that data to log you in — nothing more — and we don't post anything to those accounts.
We never sell your data
We do not sell, rent, or trade your personal information. Full stop.
Third parties we work with
We share information only with the service providers needed to run the store, under contract and only for the purpose we engaged them:
- Shopify — our e-commerce and hosting platform.
- Payment processor — to securely charge your payment method.
- Carriers (e.g. Canada Post, Purolator, UPS) — to deliver your order to your door.
Some of these providers may store data outside Québec. When that happens, we take steps to ensure your information receives an equivalent level of protection, as Law 25 requires.
How long we keep it
We keep your information only as long as needed for the purpose it was collected, or as required by law — for example, order and tax records are kept for the period Canadian tax law requires. When information is no longer needed, we securely delete or anonymize it.
Your rights
Under Law 25 you can, at any time:
- Access the personal information we hold about you.
- Correct information that is inaccurate or incomplete.
- Delete your account and request erasure of your information, subject to our legal retention duties.
- Portability — receive the information you gave us in a structured, commonly used technological format.
- Withdraw consent to marketing or other optional uses.
To exercise any of these, contact our Privacy Officer below. We'll respond within the timeframe set by law.
Cookies
We use cookies and similar technologies to keep you signed in, remember your Garage and language, run the cart and checkout, and measure site performance. You can manage cookies through your browser settings; blocking essential cookies may break parts of the store. Non-essential analytics cookies are used only with your consent.
Privacy Officer
As Law 25 requires, Évolution Plus inc. has a designated Privacy Officer responsible for the protection of personal information — a role currently held by the President of Évolution Plus inc. To ask a question, make a request, withdraw consent, or file a complaint, contact our Privacy Officer at privacy@evolutionplusperformance.ca (our postal address in Québec is available on request). If you're not satisfied with our response, you may contact Québec's Commission d'accès à l'information (CAI) at cai.gouv.qc.ca.
Terms of Service
These terms govern your use of the Evolution Plus Performance store, operated by Évolution Plus inc. By browsing or ordering, you agree to them.
Using the store
You agree to use the site lawfully, to provide accurate account and shipping details, and not to misuse, scrape, or interfere with the site. You must be of legal age to enter a binding contract in your province.
Pricing in CAD
All prices are shown in Canadian dollars (CAD) — one honest price, in stock in Canada. Sales taxes (GST/QST/HST) are calculated and shown at checkout based on your shipping province. Shipping is calculated and shown at checkout.
Order acceptance
Your order is an offer to buy. We accept it when we send your confirmation and process payment. We may decline or cancel an order — for example if there's a pricing error, a stock issue, or a suspected fraud — and we'll refund any charge in full if we do.
Real-stock policy
We list real, confirmed stock with honest lead times — never phantom availability. If something is on backorder, we say so up front. If stock changes after you order, we'll contact you with the real lead time and your options, including a full refund.
Off-road / competition use
Some performance parts are intended for off-road or closed-course competition use only and may not be legal for use on public roads. It's your responsibility to know and follow the laws and emissions rules in your province before installing or using a part. Évolution Plus inc. isn't responsible for fines, failed inspections, or damage resulting from off-road parts used on the street.
Limitation of liability
To the extent permitted by law, Évolution Plus inc. isn't liable for indirect or consequential damages, and our total liability for any order is limited to the amount you paid for it. Parts must be installed by a qualified professional following the manufacturer's instructions; we don't cover damage from improper installation, misuse, racing, or modification. Nothing here limits rights you have under applicable consumer-protection law.
Governing law
These terms are governed by the laws of the Province of Québec and the federal laws of Canada that apply there. Any dispute will be heard by the courts of Québec, without limiting the consumer-protection rights of residents of other provinces.
Returns & Fitment Guarantee
30-day returns
Changed your mind? You have 30 days from delivery to return most parts for a refund, as long as they're unused, uninstalled, and in resalable condition with the original packaging, hardware, and any instructions. We'll refund the price of the part once we receive and inspect it.
Fitment guarantee
This is our promise: if you bought a part for a vehicle saved in your Garage and it doesn't fit, we make it right — free return or exchange, and we cover return shipping. Just make sure the part was matched to your saved vehicle (make, model, year, engine) at the time of purchase. Universal parts and parts you bought without a confirmed fitment match aren't covered by the fitment guarantee, but may still qualify for a standard 30-day return.
How to start a return (RMA)
Email us or use your account to request a Return Merchandise Authorization (RMA). Tell us your order number and the reason. We'll send an RMA number and instructions — don't ship anything back without one, or we can't track or process it. Pack the part securely; items that arrive damaged because of poor packing may not be fully refunded.
Refund timing
Once we receive and inspect your return, we issue the refund to your original payment method within about 5–7 business days. Your bank may take a few extra days to post it.
Who pays return shipping
If the return is our fault — a fitment-guarantee miss, a wrong item, or a defect — we cover return shipping. For change-of-mind returns, the customer pays return shipping, and original shipping is non-refundable. Your refund is the full price you paid for the returned item — no hidden deductions.
What can't be returned
- Electrical parts (ECUs, sensors, wiring, gauges) once opened — for safety and warranty reasons.
- Custom-made, made-to-order, or special-order items (e.g. custom valving, custom lengths).
- Parts that have been installed, used, modified, painted, or show signs of fitting.
A defective part is always covered — if something arrives faulty or fails under its manufacturer warranty, contact us and we'll sort out a repair, replacement, or refund.
Accessibility (Ontario AODA)
Évolution Plus inc. is committed to making our store usable by everyone, including people with disabilities, and to meeting our obligations under the Accessibility for Ontarians with Disabilities Act (AODA).
Our standard
We aim to meet Web Content Accessibility Guidelines (WCAG) 2.1 Level AA. That means readable contrast, keyboard navigation, descriptive text for images, clear labels on forms, and a layout that works with screen readers and on any device.
Ongoing improvements
Accessibility is an ongoing effort, not a one-time checkbox. We test regularly, train our team, and fix barriers as we find them. Some third-party content (like an embedded payment window) may not be fully under our control, and we'll always offer an alternative way to complete your purchase if you hit a wall.
